That isn't accurate - Bioamber would have to be acquired as a going concern to take advantage of the losses as tax write-offs.
The IRS (in Section 382 of the tax code) has eliminated the sale net operating loss carryforward for corporations that have ownership changes greater than 50%.
It was an asset sale which means the tax write-offs can't be used

I'll recommend that you, also, read the 6th monitor's report for the first time ever. I've included a link so you can do that. The two patents in question were jointly owned by BioAmber, Inc., and Lanxess, and are shown in the APA included in that monitor's report at the bottom of page 93 (page 17 of the APA listing) and 94 (page 18 of the APA list). With Google patent, it takes about 2 minutes to cross reference any patent application number with the patent number and patent title if you're interested in learning the truth. BioAmber, Inc,'s interest in those patents were sold to LCYB per the APA, and either of them (or both) could have been listed on that form as who would receive correspondence regarding the patent.

Yes, i have checked through again and still do not see LanXess listed in that report. Unless you have insider knowledge from LCYB specifically stating that they used their new tradename "bioamber" while managing the patents, your theory is only a theory, which to your delight, is the same level of theory as anyone else posting on this board. Could you use some red lines and point out where it specifically says in the APA that fka $bioaq assigned the patents to LanXess? That is what this conversation is about. Thank you.

BioAmber completed the CCAA proceedings (Companies Creditor's Arrangement Act), on December 23, 2019 upon the filing of the Discharge Certificate. Under CCAA, (Canada law, not US) BioAmber was not in liquidation, receivership, or bankruptcy.
